Changes in the Law on Reproductive Medicin -
New Treatment Options in Austria

As from 2015, a new Law on Reproductive Medicine (Fortpflanzungsmedizingesetz - FMedG) is effective in Austria, allowing the easing of some legal constraints as well as the extension of previous regulations. This opens up new possibilities in the treatment of unintentional childlessness.

What has changed?

• Egg Donation

Couples seeking fertility treatment in Austria can make use of an IVF treatment with donor eggs.

• Sperm Donation

Donated sperm are permitted to be used in combination with all treatment methods, i.e. including In Vitro Fertilization (IVF) - where the oocyte is fertilized by sperm outside the body in a test tube. Up to now, only the insemination treatment was allowed to be used, i.e. after inducing ovulation, the donor sperm is inserted into the uterine cavity (cavum uteri). The sperm make their way through the fallopian tube, where finally fertilization of the egg takes place.

• Lesbian Couples

Another innovation concerns the access to assisted reproductive technologies for homosexual women, i.e. lesbian couples who are living in cohabitation or registered partnership. This means that it is allowed to use sperm donated by a third person, i.e. these couples are allowed to undergo IVF treatment involving the use of donated sperm.

• Preimplantation Genetic Diagnosis (PGD)

It is permitted to perform genetic testing using Preimplantation Genetic Diagnosis (PGD). Preimplantation Genetic Diagnosis (PGD) as part of an IVF treatment serves to identify or exclude the presence of genetic disorders in embryos prior to their transfer to the woman's uterus.
